Based in Washington DC, Nigel is the former global co-chair of Freshfields' market leading international arbitration practice and current co-chair of the firm’s highly-regarded Latin America practice group. He is widely acknowledged—consistently by leading legal directories and across the market—as the leading authority on international arbitration in the Americas, with particular prominence in Latin American investor-state and commercial arbitration. He has participated, as both counsel and arbitrator, in over 125 ad hoc and institutional arbitrations, including numerous high-profile treaty-based disputes that have helped set the standard for Latin American arbitration over the past 25 years. In recent months, Nigel has continued to obtain a number of major victories for his clients, including, in May 2025, a US$800 million-plus award for US renewable energy giant AES in an ICSID arbitration against Argentina, one of the highest awards ever against Argentina.
Mark is a partner in the bankruptcy and restructuring practice, based in New York. For over 35 years, he has represented financial institutions, credit funds, ad hoc lender steering committees and private equity firms in complex debt restructurings, capital solutions transactions and insolvency proceedings in a broad range of matters and industries, including health care, energy and financial services. Mark is ranked as a leading attorney across numerous directories including Chambers USA, Legal 500 USA and Best Lawyers.
