  4. 2026 New York Arbitration Week: How Much Has Really Changed – and How Much Hasn't? Energy Disputes in a Changing World

2026 New York Arbitration Week

"How Much Has Really Changed – and How Much Hasn't? Energy Disputes in a Changing World"

Freshfields International Arbitration Counsel Hinda Rabkin will be speaking on a panel titled, "How Much Has Really Changed – and How Much Hasn't? Energy Disputes in a Changing World." The panel, organized during New York Arbitration Week 2026, will be hosted at Freshfields New York office on November 20, 2026.

Arbitral institutions are reporting that energy disputes continue to generate a large number of arbitrations (ICC, ICSID etc.). The accelerating adoption of AI, and the energy required to power it, is reshaping energy demands across the US and Canada.

This panel will explore what kind of disputes will arise in this context, including under take-or-pay commitments and price review provisions in long-term power supply agreements. Industry experts, financial analysts and US and Canadian lawyers will convene to discuss the next generation of energy disputes, and how different they will really be…or not.

This event is co-organized with Young Canadian Arbitration Practitioners.

Speakers:

  • Hinda Rabkin, Counsel, Freshfields
  • James Gutman, Senior Principal Analyst, S&P Global
