2026 AAA-ICDR Conference - The Enforcement Question: Securing Value in Cross-Border Arbitration
Freshfields International Arbitration Partner Tom Walsh will be speaking at the upcoming 2026 AAA-ICDR Conference on a panel titled "The Enforcement Question: Securing Value in Cross-Border Arbitration" taking place from 3:30-5:00 pm EDT on April 30, 2026.
Enforcement remains the ultimate measure of success in international arbitration, particularly in today's volatile geopolitical and commercial environment. This session examines where enforcement risk truly lies across jurisdictions and industries, and how companies are planning for recovery well before disputes arise-through asset mapping, counterparty structuring, and contract design. Panelists will explore the effectiveness and limits of interim relief, security mechanisms, and enforcement strategies involving sovereign and quasi-sovereign entities, with particular focus on challenges in technology, IP, and energy infrastructure disputes.
The discussion will also address the growing role of funding and risk transfer in enforcement planning and conclude with what makes ICDR awards durable: procedural clarity, institutional neutrality, and resilience against set-aside and enforcement challenges.
