Freshfields' Global Co-Head of International Arbitration and Co-Head of the Latin America Practice Noiana Marigo will be moderating a panel titled "From upstream to mainstream: Exploring energy concession contracts in Latam" at the 23rd ICC Miami Conference on International Arbitration on December 2nd, 2025.
This panel will address the intersection between commercial and Investor-State arbitrations over concession contracts in the energy industry in Latin America. Energy concession contracts often involve both exploration of natural resources and construction and/or use of related infrastructure. This requires capital-intensive foreign investment over long periods, which brings together private investors, host governments, and state-owned entities, thus creating complex disputes that may be adjudicated under domestic and international arbitration frameworks. This panel will explore the interplay between these arbitration regimes, analysing jurisdictional challenges, procedural overlaps, most used legal theories, the role of domestic courts, the substantive implications of dual-track arbitration, and how tribunals navigate these issues.
