Perspectives on delay in arbitration and targeted solutions: a data-driven discussion
Freshfields' International Arbitration Partner and Head of International Arbitration - Americas Elliot Friedman will be speaking on a panel titled "Perspectives on delay in arbitration and targeted solutions: a data-driven discussion" on November 18, 2025 organized by HKA and hosted by Freshfields during the 2025 New York Arbitration Week.
While efficiency has long been a key selling point for arbitration, the rising duration and cost of proceedings are a well-known and much-debated concern. While the most striking or extreme delays understandably get the most airtime, they don’t necessarily reflect the broader patterns or underlying causes.
This panel will (1) explore the perspectives of key stakeholders—supported where possible by data—to identify the principal choke points in proceedings; and (2) discuss practical solutions to common sources of delay, including case management strategies and potential institutional reforms, to improve efficiency while preserving the integrity of the arbitral process.
