Freshfields' International Arbitration Partner and Head of International Arbitration - Americas Elliot Friedman will be moderating a panel titled "US Court's upcoming/recent decisions" at GAR Live: North America 2025 on September 16, 2025 hosted at White & Case's office in New York.

The US Supreme Court has an unusually high number of cases with a bearing on international arbitration ahead. This panel will go beneath the surface of cases and explore what the outcomes do/may mean for practice in the US. Topics to be discussed include: (1) Interpretation of sovereign immunity cases - fallout from the CJEU's intra-EU investment arbitration ruling; (2) Practical limits to enforcing awards - the contested CITGO auction; (3) How do the US courts treat states refusing to comply with awards?; and (4) Anti-suit injunctions.
