The panel which will be moderated by Professor Neil Popovic will delve into the complex dynamics between ESG objectives and investor-State dispute settlement mechanisms. The discussion will focus on the rising trend of foreign investors to leverage ISDS to challenge state climate and environmental actions. Participants will explore potential avenues to address this issue, considering the inclusion of ESG protections in international treaties and the emergence of new claims and defenses.

This year’s Stefan A. Riesenfeld symposium titled “ESG & International Law” will convene legal experts, policymakers, and industry leaders to explore the intricate relationship between Environmental, Social, and Governance (ESG) considerations and international legal frameworks.
