Powering the AI boom: Germany's Reifegradverfahren and the shift from first-come to first-ready grid connections

The German grid operators' new maturity-based procedure, the Reifegradverfahren, changes how scarce transmission-grid capacity is allocated to data centres and other large power users. It is the German expression of a broader European shift away from “first come, first served” towards “first ready, first served”. For data-centre projects, obtaining and keeping a connection position now depends on demonstrable progress, not just the date of application.

Grid connection queues are the real bottleneck for German data centres

AI-driven demand for data-centre capacity is growing faster than many network nodes can absorb. In several German regions, the binding constraint for data-centre developments is not the availability of green or affordable electricity, but the time needed to secure a grid connection.

German law grants a right to connection, but not to a chosen capacity, location or timetable. The German Energy Industry Act (Energiewirtschaftsgesetz – EnWG) requires network operators to connect final consumers on reasonable, non-discriminatory and transparent terms; it allows refusal only where connection is operationally, technically or economically impossible or unreasonable (section 17 EnWG). It does not say how to rank competing applications once demand exceeds capacity. Operators so far defaulted to processing requests in order of receipt (the so called Windhundprinzip). This let early-stage applications block capacity that more advanced projects could have used sooner.

Germany’s four transmission grid operators (50Hertz, Amprion, TenneT and TransnetBW, the TSOs) responded with the Reifegradverfahren, a maturity-based allocation procedure applying since 1 April 2026. Its premise is simple: scarce capacity should go to the most realisable projects, not to whoever applied first.

How the Reifegradverfahren allocates grid connection capacity

The Reifegradverfahren leaves a project’s connection right untouched. It only changes how TSOs rank competing applications once demand exceeds capacity. The TSOs have devised this procedure on the basis that the current statutory rules in the EnWG (only) require TSOs to use non-discriminatory, transparent terms but prescribe no particular allocation method. A firmer statutory footing is on the way: The German Ministry of Economic Affairs’ draft "Netzpaket" provides for a new section 17a EnWG, requiring TSOs to devise a unified procedure for connections to the transmission grid which is subject to confirmation by the Federal Network Agency (Bundesnetzagentur). The draft operates on a tight timeline, requiring the TSOs to submit their proposed procedure to the Federal Network Agency for confirmation by 1 January 2027. It also does not foresee any transitional provisions for ongoing connection requests — a live risk for applicants.

Under the current Reifegradverfahren, applications are processed in fixed cycles. Applicants pay a EUR 50,000 flat application fee and are scored against weighted maturity criteria, such as land control and permitting, technical design, financial and delivery capability, and grid benefit. Successful applicants receive a binding offer, which they can accept by paying a realisation deposit of EUR 1,500/MW within a set deadline. Missing that deadline lets the reservation lapse. The deposit is credited in full against the subsequent construction-cost contribution (Baukostenzuschuss) if the project is realised, and forfeited only where the project fails for reasons within the applicant's control.

Furthermore, winning the allocation is not the end of the timeline. The connection right is subsequently documented in a grid connection agreement (Netzanschlussvertrag) with the TSO, including, typically, a commissioning milestone (Inbetriebnahme) tied to the TSO‘s right to withdraw the connection if that schedule is missed for reasons within the developer‘s control. In other words, a certain maturity logic continues to apply through the grid connection agreement until the facility is actually built and energised. For data-centre developers, whose construction and fit-out timelines are long and equipment-dependent, the commissioning milestone is therefore a further important point to monitor.

EU grid connection rules: Binding law versus non-binding guidance

The Reifegradverfahren is the German iteration of principles also now promoted more broadly at EU level: The Commission’s December 2025 Notice on efficient and timely grid connections, part of the European Grids Package, recommends “first-ready, first-served” allocation, a “use it or lose it” milestone-based queue management and reservation fees proportionate to project size. For now, however, the Notice remains a non-binding policy guidance.

A data-centre-specific strand is developing on top of this. In June 2026, the Commission advanced a Strategic Roadmap for Digitalisation and AI in the Energy Sector, a voluntary “tripartite agreement” model for data centres, and a planned Cloud and AI Development Act offering simplified permitting and priority connections for sustainable projects. The Roadmap is voluntary for now, with binding legislation flagged only as a fallback. The direction of travel is nonetheless clear, and Germany is already ahead of it.

Diligence checklist for a German data-centre grid connection

Project developers and investors considering German data-centre investments should weigh the following points on grid connection:

  • Identify which procedure governs the request and test the available project documentation against the published maturity criteria.
  • Treat the grid connection position as conditional until construction is well underway. Track the acceptance deadline and the realisation deposit at the allocation stage, and, in the grid connection agreement, scrutinise the commissioning milestone: how it is defined, whether it can be extended, its application to delays outside the developer’s control, and the termination rights that attach to missing it.
  • Price the regulatory-change risk: the Netzpaket could put the Reifegradverfahren on a firmer footing but also change it, and the Commission may legislate if the voluntary EU measures fail.

Conclusion: Grid connection positions now require ongoing diligence

Applying early used to be enough. Under the Reifegradverfahren, and given the direction EU policy is taking, a connection position now must be earned and then actively maintained, from the maturity scoring at the queue stage right through to the commissioning milestone in the grid connection agreement. Securing grid connection is thus turning into a continuing diligence and drafting exercise, not a one-off filing.
