- Li-Cycle Holdings Corp. and its U.S. subsidiaries in Chapter 15 proceedings in the U.S. Bankruptcy Court for the Southern District of New York; advised the foreign representative in seeking recognition of Canadian CCAA proceedings and related cross-border restructuring strategy.
- JTI-Macdonald Corp., a leading Canadian tobacco manufacturer and subsidiary of Japan Tobacco Inc., in its cross-border restructuring and Chapter 15 proceedings in the U.S. Bankruptcy Court for the Southern District of New York. Advised the foreign representative in obtaining U.S. recognition and enforcement of a Canadian CCAA plan and global settlement resolving multi-billion dollar tobacco litigation, including releases for JTI and related parties.
- Scania CV AB, as debtor-in-possession (DIP) lender and largest customer, in connection with the Northvolt Chapter 11 proceedings in the U.S. Bankruptcy Court for the Southern District of Texas, including the provision of $100 million in DIP financing to support Northvolt’s restructuring and continued operations.
- Rite Aid Corporation and 119 affiliates in their Chapter 11 cases in the U.S. Bankruptcy Court in the District of New Jersey, involving $3.45bn in DIP financing and a $2bn deleveraging recapitalization; resolved over $2.5bn in litigation and secured $2.975bn in exit financing.
- Prima® Wawona, the largest U.S. stone fruit producer, in Chapter 11 proceedings in Delaware; advised on a $1bn debt restructuring and equitization transaction dividing assets between PropCo and OpCo lenders.
- Bed Bath & Beyond, Inc. and 73 affiliates in Chapter 11 cases in the U.S. Bankruptcy Court for the District of New Jersey; advised on prepetition capital raising and credit agreement amendments, and supported an orderly wind-down and sale process.
- BlockFi Inc. and subsidiaries in Chapter 11 cases in the U.S. bankruptcy court for the District of New Jersey; advised on restructuring strategy following cryptocurrency industry disruption to consummate a comprehensive restructuring transaction that maximizes value for its clients and stakeholders.
- Cineworld Group plc, in Chapter 11 cases in the U.S. Bankruptcy Court for the Southern District of Texas; advised on restructuring of $5.1bn in funded debt and $2bn DIP financing.
- Aearo Technologies LLC and affiliates in Chapter 11 cases in the U.S. Bankruptcy Court in the Southern District of Indiana; advised on restructuring of a market leader in energy control solutions.
- Nordic Aviation Capital, the world’s largest regional aircraft lessor, in prearranged Chapter 11 cases in the U.S. Bankruptcy Court for the Eastern District of Virginia. With over $7.7 $7.7bn in liabilities, NAC was the largest chapter 11 filing in 2021.
- J.C. Penney Company, Inc. and 17 affiliates in prearranged Chapter 11 cases; advised on a balance sheet deleveraging supported by a broad RSA and stakeholder consensus.
