Fan is a senior associate based in our Shanghai office and currently on secondment to our Hong Kong office. She advises extensively on employment, incentive, data privacy and cybersecurity related matters in an advisory and transactional context, primarily in China with an extension to the APAC region.
Fan has substantial experience in advising employment aspects of international transactions in China. Her expertise also includes share incentive plans, employee investigations, workforce restructurings and executive terminations, and day-to-day employment law advisory for numerous companies.
Fan has also been advising extensively on data privacy and cybersecurity related issues and presenting their implications to a variety of multinational companies in the APAC region. She has also advised on China and APAC data protection issues in the context of M&A transactions.
Fan has completed two client secondments, serving as the sole data privacy counsel in China for PayPal, and assisting Alibaba with its employee share incentive plans.
Fan has written various articles on data privacy, employment and workplace issues in China (China Daily, Caixin, Freshfields Risk & Compliance blog and Digital blog).
Fan is fluent in both English and Mandarin.
- Advising PayPal on the employment and benefits aspects of its acquisition of a Chinese payment company and post transaction employee integration.
- Advising Alibaba on its daily implementation and administration of the onshore and offshore employee share incentive plans in CHina.
- Advising a major US pharmaceutical company on its establishment of employee representative congress in China.
- Advising multinational companies, including BMW, Siemens, Continental, Gulfstream, Jack Wolfskin, on their executive and expatriates’ employment issues in China.
