Freshfields acts on Eurotunnel’s settlement over freight contracts

Freshfields Bruckhaus Deringer LLP (‘Freshfields’) represented Eurotunnel, a subsidiary of Getlink SE, on its litigation and settlement against the Department for Transport (DfT) over a decision made by the DfT to award contracts to three additional shipping suppliers as part of its Brexit preparations. 
 
Eurotunnel challenged this procurement as being unlawful under the Public Contracts Regulations 2015.
 
Freshfields put together a combined public procurement, judicial review and state aid challenge, and secured a highly expedited trial within weeks of the claim having been issued. The matter was settled the day before the trial was due to begin.
 
The specialist, multidisciplinary Freshfields team was led by partners Deba Das (EU and commercial public law), Sally Roe (specialist public procurement) and Rod Carlton (state aid).
 
Eurotunnel manages the Channel Tunnel infrastructure and operates Truck and Passenger Le Shuttle services (cars and coaches) between Folkestone, UK and Calais, France.
