About Dr. Martin Schiessl

Martin’s work mainly involves structuring transactions for investors in order to minimise their exposure to tax. His principal aim is to ensure that his clients suffer no tax leakage across national borders and he uses his considerable knowledge of different jurisdictions to achieve this.

Clients from Europe, North America and Asia rely on Martin’s advice. His recent experience includes tax structuring for public takeovers and ensuing restructuring of the target company; transactions relating to former public housing enterprises; real estate portfolio transactions; mezzanine capital market based financing structures for German companies; and joint venture transactions.

Martin also advises clients on tax claims made by the authorities and negotiates on their behalf to mitigate any amounts owed. This includes advising his clients in connection with complex binding ruling matters and tax audits involving cross-border matters.

He speaks German, English and French.

  • Structuring the acquisition of real estate portfolios and financing of the acquisition.
  • Structuring a public offer including subsequent restructuring of the target.
  • Structuring several portfolios of mezzanine financing and its capital market-based funding.
  • Representing before the Bundesfinanzhof in a procedure for qualifying a real estate transaction as a sale of a business as a whole.

Qualifications

Education

  • Universities of Erlangen, Exeter (LLM), Bremen and Geneva, trained in Hamburg (Referendariat)
  • Doctorate in law 

Professional qualifications

  • Fachanwalt für Steuerrecht (specialised tax lawyer)

Additional responsibilities

  • Teaches tax law at the Goethe-Universität Frankfurt am Main.
  • Was appointed national reporter for the 2002 IFA Congress in Oslo (“Form and Substance in Tax Law”)
