About Holger Hartenfels

Holger advises financial institutions such as banks, investment firms and payment service providers as well as non-regulated companies on German and European banking and financial regulation of the European Central Bank (ECB) and the Federal Financial Supervisory Authority (BaFin).

Having worked many years as senior counsel of a global systemically important bank, he has particular expertise in prudential regulation and recovery and resolution including the relevant supervisory practice of the ECB and BaFin. He particularly advises his clients on licensing requirements, organisational and reporting requirements, outsourcing, capital requirements and the use of internal models.

He specialises on the prudential regulation of trading activities, namely governance requirements, trading book barriers, market and counterparty credit risk, capital requirements for securitisation positions and purchased credit portfolios, credit risk mitigation, clearing and margin requirements for OTC derivatives and the use of financial market infrastructures like securities settlement systems and clearinghouses.

Before joining the financial industry, Holger worked for many years as counsel of a one of the central associations of German banks. He was responsible for the development of the German documentation for derivatives and securities financing transactions as well as for the regulatory recognition of contractual netting agreements.

He speaks German and English.
