Treaties (including Bilateral Investment Treaties) and Conventions
One of the significant advantages of international arbitration is the greater enforceability which arbitration awards by comparison with judgments of national courts. There are numerous international treaties and conventions which have made a substantial contribution towards:
- the protection of the establishment of international investments;
- a legal framework for the resolution of international commercial disputes through arbitration; and
- the recognition and enforcement of foreign arbitral awards.
