Experience

Yaraslau "Yarik" Kryvoi focuses his practice on investor-state and commercial arbitration, particularly on disputes involving Eastern Europe and Central Asia.

His recent experience in the area of investor-state disputes includes advising:

  • an Eastern European government in an investment dispute under a bilateral investment treaty, before the World Bank's International Center for the Settlement of Investment Disputes (ICSID);
  • a United States investor in an expropriation dispute against Islamic Republic of Iran in the US courts under customary international law and a bilateral treaty with investment protection provisions; 
  • a consortium of international energy companies in a dispute against the Republic of Kazakhstan;
  • a major United States oil company in a dispute under UNCITRAL Rules against an Eastern European country arising out of a product sharing agreement.

His experience in commercial arbitration includes advising:

  • a Mexican phosphoric acid distribution company in a supply-contract dispute with a Moroccan company in ICC arbitration proceedings in Paris;
  • a Russian investor in the telecoms sector in Stockholm Chamber of Commerce (SCC) arbitration proceedings and related multi-jurisdiction litigation;
  • a leading Russian retail chain in London LCIA proceedings arising out of post-acquisition disputes.

Prior to joining Freshfields, Dr Kryvoi worked for a major international law firm in Washington, DC.  He also served as an extern law clerk for Judge Stephen F. Williams of the US Court of Appeals for the DC Circuit.

He is a corresponding editor of International Legal Materials (ILM) and a member of International Advisory Board of International Encyclopaedia of Laws published by Kluwer Law International.

Dr Kryvoi has law degrees from Harvard Law School, Moscow and Saint Petersburg.  He also studied law in Oxford and Nottingham in England.
