EU appeals judgment of the Brussels Commercial Court dismissing damages claim following the Commission’s Elevator and Escalator infringement decision

In 2008, the European Union, represented by the EU Commission, filed the first ever claim for damages following the decision of the EU Commission imposing fines on five manufacturers of elevator and escalators. In a judgment of 24 November 2014, the Brussels Commercial Court sided with the elevator manufacturers and dismissed the claim in its entirety. The Court ruled that the Commission had failed to prove that actual damage was suffered.
